ATLANTA (April 24, 2023) | Today, Governor Brian Kemp signed Senate Bill 213 into law in Augusta, Georgia. SB 213, sponsored by Chairman of the Senate Committee on Ethics, Sen. Max Burns (R – Sylvania), would permit property owners to replace an existing manufactured or mobile home with a new home, even if it causes a continuance of non-conforming use of property.
“In order to maintain our status as the number one state to do business, we must continue to pass legislation that ensures our property owners are able to increase their quality of life when purchasing affordable housing,” said Sen. Burns. “I am thankful to the Georgia General Assembly and Governor Kemp for their work in supporting Georgia’s fast-growing economy and workforce through this measure. I am eager to continue to do my part in introducing legislation that will back Georgia’s hardworking property owners.”
This legislation will prohibit local governments from adopting or enforcing any zoning decision, ordinance, regulation, restriction or condition that was not enforced in the previous home. Additionally, this measure details the circumstances that would allow for local governments to continue implementing lawful non-conforming use of property.
