Senate Bill 179 passes to encourage competitive proposals for public works construction projects

ATLANTA (March 4, 2013) – The Senate passed Senate Bill 179 by a vote of 48 to 0. Sponsored by Sen. Hunter Hill (R-Smyrna), this bill eliminates the need for bid bonds when the state or a local government invites competitive proposals for a public works construction project.

“I am pleased by today’s passage of Senate Bill 179,” said Sen. Hill. “This legislation will allow the state and local governments to engage contractors in a similar manner to private sector contractors, providing more competitive pricing, service and results.”

Senate Bill 179 also authorizes state and local public works construction contracts to collect compensation for the completion of late construction projects. In addition, this legislation also provides incentives for early project completion. All compensation and incentive provisions must be established in advance as part of the construction agreement.

Senate Bill 179 will now travel to the House of Representatives.
