Sen. Hamrick Commends Committee Passage of Legislation Questioning Constitutionality of Federal Healthcare Bill

ATLANTA (Feb. 1, 2010) – Today, Sen. Bill Hamrick (R-Carrollton) commended the Senate Judiciary Committee’s passage of two resolutions, proposed by Sen. Judson Hill’s (R-Marietta),  urging Attorney General Thurbert Baker to investigate the constitutionality of House Resolution 3590 (HR 3590) or the “Patient Protections and Affordable Care Act.”

“It is important for the voice of Georgians to be heard by federal law makers,” said Hamrick. “These resolutions will ensure that our message is loud and clear.”

Georgia is one of many states across the country looking into the legality of this legislation. There are many experts that agree this is unconstitutional and fiscally irresponsible. The cost of maintaining such a health care system, estimated at $1 billion, could seriously endanger other essential state programs. HR 3590 is waiting final passage in the U.S. Congress.

Senate Resolution 829 is a Senate resolution, which only requires two-thirds majority in the Senate. It urges Attorney General Baker to investigate the constitutionality of HR 3590 on behalf of only the Senate. Senate Resolution 830, is proposed as a General Assembly resolution, which must achieve two-thirds majority in both the House and the Senate. It urges Attorney General Baker to investigate the constitutionality of HR 3590 on behalf of the entire General Assembly.
